What is the condition mentioning the presence or absence of asbestos?

What is it ?
The asbestos state (or asbestos diagnosis) is a diagnosis that identifies the presence or absence of materials or products containing asbestos.

Which accommodations are concerned?
It must be carried out in the event of the sale of a dwelling (apartment, individual house) if the building permit was issued before July 1997.

Dependencies are also affected.

Who carries out the diagnosis ?
You must use a certified diagnostician.

Transmission of diagnosis
You must integrate this diagnosis into the various diagnoses included in the technical diagnostic file (DDT).
You must give the DDT to the purchaser at the time of signing the promise of sale or the deed of sale.

Consequences in the presence of asbestos
  • Periodic assessment of the state of conservation of asbestos-containing materials or products
  • In-depth risk analysis
  • Corrective actions and precautionary measures up to and including asbestos containment or removal work

How long is the diagnosis valid?
It all depends on how old the diagnosis is.
  • Diagnosis made before April 1, 2013
The diagnosis must be renewed before the sale of the dwelling.
  • Diagnosis made from 1 April 2013
The diagnosis has an unlimited period of validity.

However, it is advisable to have a new diagnosis carried out on the occasion of the next sale if renovation work has been carried out in the housing. The work may highlight materials or products containing asbestos that were not previously visible.
